THIS PRIVACY POLICY ("POLICY") CONSTITUTES A LEGALLY BINDING STATEMENT GOVERNING THE USE OF THE MPESA ANALYZER APPLICATION (THE "APPLICATION", "APP", "WE", "US", OR "OUR").
THIS POLICY IS INTENDED TO PROVIDE TRANSPARENCY REGARDING THE COLLECTION, PROCESSING, USE, DISCLOSURE, RETENTION, AND SAFEGUARDING OF INFORMATION IN CONNECTION WITH THE APPLICATION.
BY DOWNLOADING, INSTALLING, ACCESSING, OR OTHERWISE USING THE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THE TERMS SET FORTH HEREIN.
This Privacy Policy shall be governed by and construed in accordance with the laws of the Republic of Kenya.

This Policy applies exclusively to Mpesa Analyzer and governs information processed in connection with the operation and functionality of the Application.
Nothing contained herein shall be interpreted as creating rights or obligations beyond those expressly provided by applicable law.
Mpesa Analyzer has been designed with a privacy-by-design architecture.
We do not collect, obtain, process, record, retain, store, transfer, transmit, sell, lease, share, monetize, or otherwise exploit personal data through external servers, cloud infrastructure, databases, or third-party systems.
The Application does not require:
The Application may request permission to read SMS messages located on the user's Android device solely for the purpose of identifying and analyzing M-Pesa transaction messages and presenting information to the user.
Such access is limited exclusively to the provision of the intended functionality of the Application.
No SMS content is transmitted to us, copied to our servers, or disclosed to any third party.
All processing performed by Mpesa Analyzer occurs locally on the user's device.
The Application operates substantially offline and does not require an internet connection for its primary functions.
No transaction records, account balances, SMS messages, or related information are synchronized or uploaded to remote infrastructure maintained by us.
Any information accessed by the Application is utilized solely for the lawful and legitimate purpose of providing the services and features made available through the Application.

In order to support the continued development, maintenance, and availability of the Application, advertisements may be displayed within certain portions of the Application from time to time.
The display of advertisements constitutes a means of generating revenue to facilitate the operation and ongoing improvement of the Application and does not alter the privacy commitments set forth in this Policy.
The Application does not disclose, sell, rent, license, or otherwise provide SMS messages, M-Pesa transaction details, phone numbers, contact information, financial information, or any other personally identifiable information to advertisers.
Advertisers are not provided with information capable of directly identifying users of the Application, nor are they granted access to SMS content or any records analyzed locally on the device.
No advertising partner receives copies of transaction histories or information derived from SMS messages processed by the Application.
Any advertising services that may be utilized operate independently under their own terms and privacy policies. Such services are contractually and technically separate from the local processing performed by the Application.
Nothing in this section shall be construed as permitting the disclosure of personal data in a manner inconsistent with the Constitution of Kenya, 2010, the Data Protection Act, No. 24 of 2019, or any other applicable law of the Republic of Kenya.

Accordingly, the Application is provided without warranties, express or implied, regarding uninterrupted operation or absolute security.
Mpesa Analyzer is intended solely for individuals who are eighteen (18) years of age or older.
Persons under the age of eighteen (18) are not authorized to use the Application.
We do not knowingly collect information from minors, and any such information, to the extent it may inadvertently come into existence, shall be deleted where technically feasible.
Mpesa Analyzer is an independent software product.
The Application is not affiliated with, sponsored by, endorsed by, approved by, or otherwise associated with Safaricom PLC or the M-Pesa mobile money service.
The Application does not directly access Safaricom systems, M-Pesa accounts, or financial infrastructure.
References to "M-Pesa" are made solely for descriptive purposes.
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE".
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
TO THE MAXIMUM EXTENT PERMITTED UNDER THE LAWS OF KENYA, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE USE OF THE APPLICATION.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY THE USER FOR THE APPLICATION, IF ANY.
Should any provision of this Privacy Policy be determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such determination shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
We reserve the right, in our sole discretion and without prior notice, to amend, modify, revise, or replace this Privacy Policy from time to time.
Continued use of the Application following publication of any revised version shall constitute acceptance of such revisions.
Any dispute arising out of or in connection with this Privacy Policy shall be subject to the exclusive jurisdiction of the courts of the Republic of Kenya.
